On November 4th Dave is scheduled to appear before a judge, and the prosecution will once again make their argument for Dave to remain in prison while they continue their investigation. Rumors that Dave died in prison are untrue. However, it is true that Dave’s mother recently passed away. Dave will not be able to attend the memorial, due to his indefinite imprisonment without trial in Costa Rica
Dave thanks the contributors who have donated a total of $3,102 to his cause. The money has paid for his initial attorney’s fees. Dave has $1,164 to put toward his next court appearance. His attorney is hoping to argue that since Dave is over 65 years of age, his imprisonment is illegal.
Some have asked for a recent photo of Dave, and we are sorry that is not possible, as long as he remains in prison. Bringing cameras or cell phones into the prison is strictly prohibited. Given the infamously bad conditions at the San Sebastián prison complex, it’s understandable that the government would be embarrassed by photos of the prison and the internationally recognized abuses of human rights that occur there. Occasionally inmates smuggle a camera phone into prison and publish their photos on Facebook.
In all likelihood if released, the government would lose interest in the prosecution of a tenuous political case. Costa Rica has a long history of never bringing charges against foreigners while they stay in jail indefinitely as a so-called “preventative measure”. Often the tactic is used to extract “bail money” for the judicial authorities. However, this can’t happen in Dave’s case because he is poor and will never receive in enough in donations to cover their “bail demand”.
Dave’s only chance is to continue to mount a legal defense against his indefinite imprisonment without trial, illegal detention because of his age, and attempts on the part of the judicial authorities to extort money from him with vague and untested criminal charges. With no resources of his own, you are the best hope for Dave, a 65 year old carpenter’s helper from Florida; has for getting home. Dave thanks you for your support.
